  • Litigating non-employment related trade secrets claims.
  • Advising and representing numerous clients in matters involving trade secrets misappropriation arising in contexts unrelated to employment matters, such as theft of trade secrets by a competitor.
  • Counseling clients on how to protect their trade secrets from third parties.
  • Regularly assisting clients in developing policies and procedures to clearly identify and then to protect their trade secrets from unauthorized use or distribution. These policies and procedures are often critical to obtaining injunctions or monetary damages should unauthorized use or misappropriation occur. We also routinely draft agreements for our clients that enable them to share their trade secrets with third parties for business purposes while at the same time protecting the confidential status of the trade secrets.
  • We draft employment and other agreements containing covenants not to compete.
  • We draft employment and other related agreements dealing with trade secret protection and non-compete issues. We have experience representing both the employers and employees in these agreements.
  • Litigating unfair competition claims, including Lanham Act claims.
  • Representing clients in prosecuting or defending a variety of unfair competition claims, including claims for false advertising, misrepresentation and confusion as to source.
