Law 360: Oved & Oved Commences Class Action against Apple and T-Mobile

Oved & Oved brings a class action suit against Apple and T-Mobile, on behalf of potentially more than one million consumers, for their failure to disclose to their respective consumers the need to manually disassociate a user’s Apple ID from the phone number previously associated with a discarded and expired SIM card – often used by consumers when traveling abroad – which wrongfully exposes those consumers to receiving private texts, photographs and videos via iMessage and FaceTime, that are intended for the new owner of that recycled phone number. Imagine traveling abroad on business or vacation, obtaining a temporary SIM card for that time period, returning home and reinstalling your original SIM card, and thereafter receiving photos, videos and texts – containing private, confidential or unlawful content – intended for the present owner of the phone number previously associated with the SIM card you used while abroad. For that reason, the complaint contains novel and sweeping claims against defendants whose resolution will have seminal legal implications and major business consequences.
